The Bush administration's counterterrorism policies appear tough, but inside the courtroom, they evaporate, consistently favoring not American terror victims, but foreign terrorists.

Consider a civil lawsuit arising from a September 1997 suicide bombing in Jerusalem. Hamas claimed credit for five dead and 192 wounded, including several Americans. On the grounds that the Islamic Republic of Iran had financed Hamas, five injured Americans students sued it for damages.

Expert testimony established the regime's culpability during a four-day trial, leading Judge Ricardo M. Urbina, under the Flatow Amendment of the Foreign Sovereign Immunities Act, to fine the Iranian government and its Revolutionary Guard Corps US$251 million in compensatory and punitive damages.

The plaintiffs looked for Iranian government assets in the United States to seize, in accord with the little-known section, 201a of the Terrorism Risk Insurance Act of 2002, which states that "Notwithstanding any other provision of law … in every case in which a person has obtained a judgment against a terrorist party on a claim based upon an act of terrorism … the blocked assets of that terrorist party … shall be subject to execution."

Finding Iranian assets, however, proved no easy task, as most of them had been withdrawn by the Iranian authorities after the embassy hostage crisis of 1979-81. Therefore, the victims' lead lawyer, David Strachman of Providence, R.I., devised some creative approaches, such as intercepting the imminent return of ancient Iranian clay tablets on loan to the University of Chicago for up to seventy years.

NOVEMBER 6--An al-Qaeda operative serving life in prison for his role in the bombing of American embassies in Africa contends that his rights are being violated by U.S. jailers who have denied him access to Arabic publications and religious books, limited his mail privileges, and no longer allow him to use a Walkman. Mohamed Al-Owhali, 32, claims that his incarceration at the "supermax" federal prison in Florence, Colorado has left him so severely depressed that he stopped eating for months, forcing Bureau of Prisons officials to feed him via a tube placed through his nose. In a new U.S. District Court lawsuit, Al-Owhali wants a judge to order prison brass to provide him with expedited mail services, expanded phone privileges, and access to radio and TV news broadcasts and English and Arabic newspapers and magazines. Currently, Al-Owhali claims, he is only provided with month-old copies of USA Today, "with several pages-sections removed." The convicted terrorist is held in virtual isolation in a special security unit at Florence, per Department of Justice guidelines known as Special Administrative Measures. Attached to Al-Owhali's handwritten October 19 lawsuit is a copy of an internal BoP complaint form filed by the inmate (a copy of which you'll find below) and a BoP memo to Al-Owhali detailing the SAM measures governing his incarceration. The most familiar possible situations involve the detonation of a dirty bomb, a modest amount of high explosive mated to a container of radioactive material. But radioactive material inside the human body is far more dangerous than a dirty bomb.
Most analysts believe that about 10 people would die from radiation poisoning after a dirty bomb attack. Others believe that the only people likely to receive a lethal dose of radiation from a dirty bomb would already be dead from the blast. A perfectly feasible terrorist attack using the ingestion, inhalation or immersion of radioactive material, on the other hand, would be almost certain to kill hundreds. We call attacks of these kinds I-cubed attacks (for ingestion, inhalation and immersion). Such attacks can be sneaky, unaccompanied by a flash and bang.

Osama bin London

This article is a good look into how Muslim recruiters radicalize young men to carry out terrorist attacks. It’s interesting that the primary actor Hamid was only noticed by authorities when he was arrested for “behaving aggressively” toward the public. He was then placed under surveillance.

While informative, the article raises some questions in my mind. First and foremost is how many Hamids are there and how many young men are ready to follow them? Then there is the question of how to find and track likely terrorists before they strike.

As time goes on it is imperative that ordinary citizens become aware of the threat and make a point of reporting suspicious activity no matter how innocent it otherwise seems. Without citizen input, the authorities have fewer starting points to investigate.
'Osama bin London' Muslim fanatic 'trained 21/7 bombers'

A Muslm fanatic who mockingly called himself "Osama bin London" radicalised and trained the July 21 bombers, a court heard yesterday.
Mohammed Hamid is said to have taken his brainwashed followers on paintballing trips and training camps in the English countryside to prepare them for fighting.
Under his instruction, the young men allegedly performed military-style training, brandishing sticks as if they were guns and practising tactics to counter an armed ambush.

One of the paintballing trips, attended by July 21 bombers Ramzi Mohammed and Hussain Osman, took place just four days before the July 7 attacks and two weeks before the two men carried out their own attempt.
On the night of July 7, 2005, after the terrorist attacks earlier that day, Hamid allegedly texted Osman: "We fear no one except Allah, we will not change our ways, we are proud to be a Muslim and we will not hide."
One of Hamid's expeditions was even filmed by a BBC television crew making a documentary called "Don't Panic, I'm Islamic".

It also aspires to make Islamic (Shari’a) law the sole basis of jurisprudence and governance. Toward this purpose -- encapsulated in the Brotherhood’s militant credo: “God is our objective, the Koran is our Constitution, the Prophet is our leader, struggle is our way, and death for the sake of God is the highest of our aspirations” -- the Brotherhood since its founding has supported the use of armed struggle, or jihad. The Brotherhood supports the waging of jihad against non-Muslim “infidels,” and has expressed support for terrorism against Israel, whose legitimacy the Brotherhood does not recognize, and against the West, particularly the United States.

Hamas (an acronym for Harakat al-Muqawamat al-Islamiyya, or "Islamic Resistance Movement") is a radical fundamentalist group founded on December 14, 1987 by the Muslim Brotherhood. ( Hamas describes itself as "one of the wings of the Muslim Brother[hood].") As a single Arabic word rather than an acronym, "Hamas" means "zeal." Its avowed purpose is "liberating Palestine" from the Jew "oppressors," whose presence in the Middle East it considers an affront to Muslims' rightful sovereignty in the land of the Prophet Mohammad. The organization's individual co-founders were Ahmed Yassin and Abdel Aziz al Rantisi.

With tens of thousands of loyal supporters, Hamas' strength is concentrated principally in the Gaza Strip and a few areas of the West Bank. The group's leadership is dispersed throughout these same areas, with a few senior leaders residing in Syria, Lebanon, and the Gulf States. Hamas receives some funding from Iran but is supported primarily by donations from Palestinian expatriates around the world and private benefactors in Arab nations. Some clandestine fundraising takes place in Western Europe and North America as well. When the United Nations Oil-For-Food program was in effect, Saddam Hussein skimmed more than $21 billion from its coffers and sent some of it it directly to Hamas.

When Zorkot refused to comply with officers’ orders, he was stunned again and taken into custody. As police placed him into the back of a patrol vehicle, he allegedly said: “You think this is over? This is not over.”
Evidence technicians then searched his vehicle and found two pairs of cloth gloves; a military combat belt with a canteen and two knives; boots with socks; a receipt for the AK-47 rifle and ammunition; a gunlock and keys; a list of metropolitan Detroit shooting ranges; numerous photographs of Zorkot standing in front of a billboard depicting “various Muslim extremists;” a briefcase containing a laptop; and a cell phone.
Two cameras, a portable AM/FM radio, a pair of binoculars, four computer CDs, an Army surplus bag, a camouflage face paint kit, a Lebanese flag, a VCR cassette of “The Never Ending Story,” and eight prepaid international phone cards were also found inside the vehicle.
Based on the statements he made at time of his arrest, and the materials found inside his vehicle, a search warrant was issued for Zorkot’s home. Dearborn police have partnered with the FBI in Detroit to examine the items seized during that search.

The Islamist Head Fake

It's now believed that several leaders of the Muslim establishment in America last decade conspired to infiltrate the U.S. political system, change Middle East policy and gradually Islamize America. At the same time, they hatched a plot to fund overseas terrorists.
Of course, they couldn't do this out in the open. So they set up benign-sounding nonprofits and charities to "camouflage" their traitorous activities, say U.S. prosecutors who cite wiretap transcripts and other documents uncovered in a criminal probe of the Holy Land Foundation, the largest Muslim charity in America.
During a secret meeting at a Philadelphia hotel, the charity's president and other prominent Muslim leaders were recorded allegedly plotting ways to disguise payments to Hamas terrorists as charity.
"I swear by Allah that war is deception," said Shukri Abu-Baker, now on trial in the federal terror-funding case. "We are fighting our enemy with a kind heart. . . . Deceive, camouflage, pretend that you're leaving while you're walking that way. Deceive your enemy."
Another participant at the Hamas summit was the founder of the Council on American Islamic-Relations, or CAIR, the largest Muslim civil-rights group in the country and an unindicted co-conspirator in the terror-funding case.
Adding to Abu-Baker's point, Omar Ahmad compared the deception needed to fool the infidels with the head fake in basketball. "He makes a player believe that he is doing this while he does something else," Ahmad said. "I agree with you. . . . Politics is a completion of war."
The Islamist head fake has worked all too well over the past decade. Blind acceptance and validation of Muslim leaders with questionable loyalties hardly missed a beat in Washington even after 9/11.
Many were invited to the White House and Congress. The head of the FBI spoke at their conferences, calling them "mainstream" and "moderate." Many naive officials still confer legitimacy on them.
But what Muslim leaders tell us and what they tell Muslim audiences are often two entirely different things. The deception is astonishing. They've really played us for suckers.
Here are just a few examples:
Sami Al-Arian: The popular and respected Muslim activist was a White House guest of both presidents Clinton and Bush. He assured his hosts he was both peace-loving and patriotic. "I am a very moderate Muslim person," he said. "I also condemn violence in all its forms."
All the while, Al-Arian was secretly running a U.S. beachhead for Palestinian terrorists. In a speech at a Cleveland mosque, he once thundered: "Let's damn America, let's damn Israel, let's damn their allies until death."
He's now a convicted terrorist.

THE mysterious sheik behind the Australian chapter of Islamist group Hizb ut-Tahrir has revealed the organisation's support for military coups and revolutions to overthrow non-Muslim governments worldwide.
Ismail Al Wahwah, who was little known until last month when he was banned from a Hizb ut-Tahrir conference in Indonesia, spoke out on an Arabic radio program that revealed him as the "active member" of the group in Australia.
In an interview conducted in Arabic on SBS radio last month, he attacked the West's lack of values and backed the use of suicide bombings in Iraq and Palestine, even if they killed Australians.
"I say any occupied people have the responsibility to defend their country," he said in the interview, which The Australian had translated into English. "The victim ... should not be asked how he is defending himself."

NEW YORK - A European terrorism suspect facing charges in the United States planned to set up a camp in Oregon to teach followers how to make bombs, poison people and slit throats, a federal prosecutor said Tuesday.
Oussama Kassir, a Lebanese-born Swede, also offered bomb and poison-making tips on several Web sites, U.S. Attorney Michael Garcia said in announcing the suspect's extradition to New York from the Czech Republic.
One of the Web sites was located on an Internet server in suburban White Plains, the prosecutor said.
"The purpose of the camp was to identify and further radicalize individuals that would be willing to carry out attacks against the United States at home or abroad," said Richard Falkenrath, deputy commissioner for counterterrorism at the New York Police Department.

Our Declaration of Independence teaches that government is instituted among men to secure life, liberty and the pursuit of happiness. The Constitution’s injunction to provide for the “common defense” requires a vigorous and vigilant approach to national security. American foreign policy dedicated to the security of the interests and rights of its citizens requires not only informed and prudent statesmanship, but also a responsible citizenry that is engaged in the national discussion about friends and foes. It is in this tradition of spirited self-government that we publish these studies.

Iran has long been one of the leading state sponsors of terrorism worldwide. Iran’s ruling mullahs are extending their regional influence in the fog of the Iraq conflict. Their pursuit of nuclear weapons and a robust ballistic missile capability continues apace. Thomas Joscelyn argues that Iran is guilty of far more. An emboldened Iran has vicariously waged war against America for nearly three decades, yet America’s leaders are unwilling to admit what is plain for all to see.

Because of our reluctance to confront this terrorist state openly, we are losing ground on a vital front in our war against radical Islam. Through careful analysis of open sources, Joscelyn explains both the intelligence establishment’s misreading of history and the numerous but unfounded assumptions by today’s elite concerning Iran and its link to terrorist operations.

One of the most damaging and unwarranted assumptions made is that sectarian differences within Islam should prevent cooperation in operations against the West. A brief look at the evidence shows that Iran and others have had no trouble in putting aside differences in theology to harm their enemies, especially America. Specific links include the Iranian connection to al-Qaeda in the Sudan, a partnership brokered by Hassan al-Turabi, one-time leader of Sudan’s ruling party, the National Islamic Front. Next, there is Imad Mugniyah, Hezbollah’s master terrorist, who helped Osama bin Laden upgrade al-Qaeda’s capabilities in the early 1990s. The 1996 Khobar Towers bombing, long suspected to be the handiwork of Hezbollah under direction from Iran, may also have had a junior partner in al-Qaeda. The 9/11 Commission established that the 1998 U.S. embassy bombings in Kenya and Tanzania were the work of Hezbollah-trained al-Qaeda operatives. There are disturbing signs that may implicate Iran in, at the very least, facilitating travel for some of the 9/11 hijackers. Finally, there is extensive evidence that Iran aided al-Qaeda’s retreat from Afghanistan in late 2001 and has allowed al-Qaeda agents to operate from Iranian soil ever since.

Recognizing this pattern is a prerequisite to restoring a sound policy towards Iran. We must be honest about Iran’s past actions over the last three decades. We must also publicly investigate Iran and Hezbollah’s possible involvement in 9/11 and other al-Qaeda attacks. Evidence not harmful to current national security assets or strategy should be declassified. We should demand that Iran turn over any al-Qaeda fighters seeking refuge on Iranian soil. Finally, we should set about the business of devising a broad and coherent strategy for confronting Iran. How we go about meeting the Iranian threat is open for debate, but we cannot hope to resolve this vital issue by continuing to pretend that Iran does not play a large role in the terrorists’ ongoing war against America.

The American regime has faced down larger and more formidable foes than Iran, Hezbollah, and al-Qaeda. But in an age of increasing technological sophistication, it is irresponsible to sit idly by while threats gather and foreign actors are allowed to carry out acts of war. The way forward requires prudence, clear strategic thinking, and statesmanship. Thomas Joscelyn’s compelling case that we must first open our eyes is a vital contribution to what we hope will be a new direction for American foreign policy.

Middle Eastern man photographing interstate bridge

I'll just let Foehammer tell this in his own refined and reserved style.

I have done quite a bit of interstate travel in my time. I have never, ever had any reason to stop to take photographs of an interstate bridge. Could be because there’s rarely anything aesthetically pleasing about interstate bridges; dirty ugly cement, flat roadway, no adornments and a few pillar supports. That didn’t keep this “Middle Eastern” man from getting out of his car to take some photographs. But it also didn’t keep him in police custody, despite the fact that he is on an FBI terrorism watch list. Now, I might hope that this is simply a case of catch, release and follow to the other bad guys, but I’m willing to bet that it’s more likely just another case of political correctness shrinking American brains. Please notice how the article goes to great lengths to avoid using the terms Muslim or Islam or any religion. Thanks to 1389 for alerting me to this story.

A New Yorker on an FBI terrorism watch list was questioned along the Interstate 80 bridge over the Delaware River Monday afternoon and then released, according to New Jersey State Police.
The 25-year-old man told officers he had stopped so his wife could feed their baby and was admiring the Delaware Water Gap scenery, police said.

Passing truckers had reported a man with Middle Eastern features taking photographs of the bridge, triggering police interest.
Ahmed’s car was searched after a background check showed his name on the federal list, police said, but no camera was found, and Ahmed was allowed to continue along his way.
“We conferred [with federal anti-terror authorities] and there was no further reason for detention,” said Capt. Al Della Fave, of the New Jersey State Police.
State and local law enforcement authorities in Pennsylvania said they later were told New Jersey police had detained and then released a suspect who’d been taking photos of the bridge.

The War on Terror: The German Front

At the root of this success is the terrible "spying" carried out by U.S. intelligence agencies. Without the work being done by our intel folks, another major terrorist plot would have been carried off in the heart of Europe. It is just inconceivable that the left continues to make every effort degrade the most potent weapon we have against global Jihad: intelligence operations. Don't these idiots realize that they are just as likely to die in a terrorist attack as anyone else? How stupid and blind can they be?

Although praise for the United States occurs very seldom in anti-American Western Europe, it was different in Germany last week. Unreported by most media outlets, the largest potential terrorist attack on German soil since the Second World War that saw three men arrested, two of them German converts to Islam, was thwarted with considerable American help.
As it turns out, according to a report in the German magazine, Der Spiegel, CIA officials had been working in close co-operation with German intelligence on this case for months, right up until the arrest of three suspects last week in an inconspicuous village in the state of North Rhineland-Westphalia. A joint team of American and German investigators had already been working in Berlin for some time on “Operation Alberich”, the name of a king in German mythology given to the project. US Secretary of Homeland Security, Michael Chertoff, told Der Spiegel that the cooperation between the two countries’ intelligence services was never closer than during this investigation.
The terrorist cell broken up last week apparently appeared on German intelligence agencies’ radar screens for the first time last fall after a warning from their US counterparts. American authorities alerted the Germans that the Islamic Jihad Union, an extremist, Uzbekistani outfit with ties to al Qaeda and to which these particular terrorists belonged, was setting up a network in their country. It is known that the IJU’s German members arrested last week had trained at terrorist camps in Pakistan in 2006 where they most likely came to the attention of the American security officials stationed there.
In Afghanistan and Pakistan, America maintains a large, clandestine intelligence-gathering effort that has already resulted in several significant victories, as already reported in FPM.
FBI teams in Pakistan have built up a network of informers, including members of Pakistan’s military and intelligence services, which pass on information for money and, according to one Pakistani writer, even for trips to the United States.

ANKARA, Turkey - Authorities thwarted a bombing, possibly timed to coincide with the sixth anniversary of the Sept. 11 attacks, as police found and defused more than 600 pounds of explosives Tuesday in a minibus parked near an Ankara market.
Turkey, a U.S. ally in the fight against global terrorism, has increased security on the anniversary of the 2001 attacks in the United States.
Sniffer dogs discovered the blue minibus at a multistory parking garage near an open food market. Its license plate was stolen from another vehicle, and the owner tipped police, the state-run Anatolia news agency said.
"A possible disaster has been prevented," Gov. Kemal Onal said as he announced the discovery at the site. Anatolia said a witness alleged that an unidentified man parked the vehicle around 6 a.m., saying he had brought goods to sell at the market.
Police evacuated houses and cordoned off the area, and explosive experts defused the bomb in three hours, Police Chief Ercument Yilmaz said.
Yilmaz did not reveal details of the bomb, but Turkish media citing other police sources said sacks of explosives were found, speculating that it could be ammonium nitrate or cheap fertilizer, an ingredient used to make bombs.

War On Terror: The co-chairmen of the 9/11 Commission buy the Democratic line that the war in Iraq is a diversion from the war on terror and a recruiting tool for al-Qaida . But it's the bad guys who are less safe.

In a Washington Post op-ed, 9/11 Commission chairman Thomas Kean and vice chairman Lee Hamilton ponder the question of whether we are safer now than we were on that tragic day.
They conclude the war in Iraq has made us less safe.
They are wrong.
"No conflict" they opine, "drains more time, attention, blood and treasure and support from our worldwide counterterrorism efforts than the war in Iraq. It has become a powerful recruiting and training tool for al-Qaida."
Considering the rapid demise of al-Qaida leaders, the terror group probably isn't offering a retirement plan, though.
Omaf Farouq, leader of al-Qaida in Southeast Asia, was one of those drawn to the jihadist cause in Iraq. In September 2006, he was killed by British troops in a firefight in Basra. In an audiotape released late that month, the leader of al-Qaida in Iraq said 4,000 such recruits had been killed in Iraq since Iraq was liberated, including leaders like Omar Farouq and Abu Musab al-Zarqawi.
What Kean and Hamilton fail to comprehend is that Islamofascists and al-Qaida will always find excuses to wage war on civilization and the West.
We weren't in Iraq on 9/11. We were in Saudi Arabia protecting that country after Saddam, the world's most prolific killer of Muslims, invaded Kuwait. Osama bin Laden used the presence of infidel soldiers on holy Saudi soil as an excuse, and a recruiting tool.
The jihadists always will have an excuse, whether it be the existence of Israel or the excesses of Western culture or a newspaper publishing offensive cartoons. In his latest videotape, bin Laden warned about Western corporations and global warming. Do Kean and Hamilton suggest we ratify Kyoto to prevent the next attack?
It is al-Qaida that has made Iraq a central front. Al-Qaida's No. 2 man, Ayman al-Zawahiri, in a letter to the leaders of al-Qaida in Iraq, said: "Victory of Islam will never take place until a Muslim state is established in the manner of the Prophet in the heart of the Islamic world" — a description that Iraq fits nicely.
"The jihad movement is growing and rising," Zawahiri wrote to the late Abu Musab al-Zarqawi in October 2005. "Now it is waging a great historic battle in Iraq, Afghanistan, Palestine and even within the Crusader's own homes."

Islamist Website Hosted in Minnesota Calls for Suicide Operations in Denmark
This is another example of The Enemy within. The greatest problem for western societies is to differentiate between Muslims who just want Sharia through political means, and those who wish to use terroristic means. Of course, even those who do not wish to participate in terroristic activity, at least passively condone terrorism, hoping it will speed the political process. Islam must be recognized as a religo-political entity bent on world domination.

On August 31, 2007, the Islamist website www.ekhlaas.cc, hosted by SiteGenie LLC in Rochester, Minnesota, posted a document calling for "martyrdom [i.e., suicide] operations" in Denmark. The author, who identified himself as a member of Al-Qaeda, urged the Muslims not to forget the incident of the Danish cartoons, and promised the people of Denmark that the "brigades of martyrdom seekers are on their way... and will soon carry out blessed operations" in their country. He called on the Muslims to register on the site as candidates for these suicide operations.
Following are excerpts from the document:
"Some Muslims have put the affair of the Danish [cartoons] behind them and have completely forgotten it... I have reopened this issue in order to irritate the infidel Danes, and to remind them that the affair is not over and that the brigades of the martyrdom seekers are on their way.
"[My] goal is to urge [my Muslim] brothers to put down their names [so as to indicate] that the affair is not over, and that they will soon set out to carry out blessed operations in Denmark. Please put down your names in order to strike fear in the hearts of the Danish people.
"I take upon myself the honorable [task] of being the first martyrdom seeker to crush the strongholds of heresy in Denmark.
"[Signed] Abu Al-Bara Al-Dosari. Place of residence: the secret state of Al-Qaeda, from which we will set forth to crush the heretic [regimes]."

BOMBS CONVOY CLOSES STREET
Torontonians were transfixed yesterday by the spectacle of police gingerly transporting three live bombs through their city, shutting down two of Toronto's busiest roadways for more than an hour after a man was arrested for a series of August letter bombings.

As news helicopters buzzed overhead, a 17-car police convoy crept slowly down the Don Valley Parkway and under the Gardiner Expressway to the waterfront Leslie Street Spit, carefully towing a trailer containing the three explosive devices seized earlier from a rental car.
Bridges over the busy parkway were sealed off and pedestrians and other vehicles kept hundreds of metres away until the bombs were carefully deposited on a deserted section of the spit, and blown up in a controlled explosion that could be heard kilo-metres away.
